In the matter of the application made by the Applicant, pursuant to paragraph 9(2)(c) of the Agriculture and Agri-Food Administrative Penalties Act (AAAMP Act), for a review of the facts of violations of subsection 139(2) of the Health of Animals Regulations (HA Regulations), alleged by the Respondent.

ORDER RESULTING FROM THE CASE MANAGEMENT CONFERENCE HELD ON JANUARY 19, 2018

[1] The parties have agreed that, based upon the availability of the witnesses, the hearing will take place in Québec City, QC, on April 26-27, 2018, and will last approximately a day and a half.
[2] At the hearing, the Canadian Food Inspection Agency (CFIA) will proceed first since the burden of proof lies with it, Transvol Ltée will proceed afterwards.
[3] The CFIA intends to call five witnesses. Their examination-in-chief is expected to last a total of three hours, whereas the cross-examination is expected to take approximately one hour. In contrast, Transvol Ltée intends to call four witnesses and complete their examination-in-chief in approximately two hours.
[4] The CFIA intends to take 30 minutes for its closing submissions, whereas Transvol Ltée intends to take two hours for theirs.
[5] With all this in mind, it has been agreed that the hearing will last one and a half days.
[6] The parties have agreed to discuss the possibility of shortening the length of the hearing, and of providing the Canada Agricultural Review Tribunal (Tribunal) a final list of witnesses by March 1, 2018, at the latest.
[7] The parties will provide to the Tribunal, no later than March 1, 2018, an amended list of exhibits of which they intend to refer to during the hearing, as well as a book of exhibits.
